Official Rules & Regulations for the Car Raffle being conducted by the Palm Beach Sanatan Vaidic Society Inc., (Shri Lakshmi Mandir of Palm Beach)

Organization:  Refers to the “Palm Beach Sanatan Vaidic Society Inc.,” AND/OR “Shri Lakshmi Mandir of Palm Beach”.  The names are used interchangeably.

By participating, you agree that:

These Official Rules govern the conduct of the raffle and are binding on everyone who donates to a raffle ticket and/or who is named on a raffle ticket. The PALM BEACH SANATAN VAIDIC SOCIETY INC., is sponsoring this fundraising activity in support of its organization, which is a not-for-profit, charitable organization with a company address of 7802 130th Avenue North, West Palm Beach, FL 33412.  The mission of the PALM BEACH SANATAN VAIDIC SOCIETY INC., is to promote and preserve the Hindu Sanatan Vaidic culture and its religious philosophy, customs, music, dance and values as contained in the holy scriptures and to provide a platform or place of worship where the members of the Organization or anyone desiring knowledge of Hindu culture and practices can participate in spiritual and religious activities.  All funds, whether acquired by gift, contribution or otherwise, shall be devoted to said purposes.

The PALM BEACH SANATAN VAIDIC SOCIETY INC., is a religious non-profit organization as described in section 501(c)(3) of the Internal Revenue Code and has received a determination letter from the IRS recognizing the organization as a 501(c)(3) organization and as such is eligible to receive tax-deductible contribution.

Rules & Regulations:

The Prize: Each contributor who has made the suggested minimum donation will have his/her ticket entered in the raffle drawing scheduled to be held in West Palm Beach, FL on December 16, 2017.  The Prizes will be donated and/or purchased by funds of the Organization and are as follows:

  1. FIRST PRIZE (GRAND PRIZE):  2017 OR NEWER HONDA ACCORD SEDAN SPORT WITH UPGRADED CVT AUTOMATIC 2.4L 4-CYL ENGINE AND STANDARD BLACK CLOTH INTERIOR AND 19-INCH ALLOY SPORT WHEEL.  NOTE: COLOR SHOWN IS MODERN STEEL METALLIC.  ACTUAL COLOR MAY VARY.  THERE ARE NO ADDITIONAL UPGRADES; MSRP $25,215.
  2. SECOND PRIZE:  NIKON – D3400 DSLR CAMERA WITH AF-P DX 18-55MM G VR AND 70-300MM G ED LENSES; MSRP $1000.00
  3. THIRD PRIZE:  APPLE iPAD AIR2, 128GB, MSRP $499.00

There will only be one ticket holder winner chosen for each of the prizes. The Grand Prize winner assumes and must pay all fees and charges (including, but not limited to, tags and license), local, state and federal taxes when the car is transferred to the winner. In addition, all costs of car ownership, such as (without limitation) insurance, are the Grand Prize winner’s sole responsibility. The winner will receive a copy of the IRS Form W-2G form reporting the value of the grand prize and the amount of taxes withheld. This offer is void where prohibited by law and all federal, state and local laws and regulations apply. The winner must have proper identification when claiming the vehicle (a valid state driver’s license) and appropriate insurance as determined by the car dealership. PALM BEACH SANATAN VAIDIC SOCIETY is not responsible for the vehicle’s quality nor shall it have any responsibility once the vehicle has been conveyed or delivered to the winner. PALM BEACH SANATAN VAIDIC SOCIETY makes no guarantee that the Internal Revenue Service (IRS) will accept any stated value of any automobile for the purpose of determining any income tax that may be due from the winner.  PALM BEACH SANATAN VAIDIC SOCIETY takes no responsibility for any tax liabilities. The Grand Prize winner is strongly advised to seek professional legal and tax advice. Award of the Grand Prize could have material adverse consequences on the Grand Prize winner including without limitation, with respect to taxes, income, government entitlements or other benefits, or other legal, financial or other matters.  Prizes for the winners of the second and third prizes will be mailed to the addresses provided on the raffle ticket.

Eligibility:

Only licensed drivers (license cannot be suspended), 18 years of age and older at time of donation are eligible to participate and enter. PALM BEACH SANATAN VAIDIC SOCIETY reserves the right to disqualify any entrant for violation of these Official Rules, any applicable laws, or who makes any misrepresentations relative to this drawing of chance. Raffle tickets may not be purchased in the name of a business, trust, corporation, or other entity, or wherever prohibited by applicable law. Prize winners may be required to sign an affidavit of eligibility. Members of the Board of Directors, their spouses, and family are allowed to participate and are eligible to win any of the prizes.  Anyone associated with the PALM BEACH SANATAN VAIDIC SOCIETY is eligible to participate in this fundraiser endeavor.  Drawing will be done by an independent individual unrelated to the foregoing.

Entry and Tickets:

No purchase or contribution is necessary to participate in the Raffle. However, the suggested minimum donation is USD $20 per ticket. Only ticket holders with validly obtained tickets are eligible to participate in the Raffle. Donations for tickets will be accepted online at the Organization’s website (www.pbsanatansociety.org) and in person or by mail until 14 days prior to the drawing. A maximum of 4000 tickets will be sold for this raffle.  Tickets may sell out before the date of the drawing.

PALM BEACH SANATAN VAIDIC SOCIETY assumes no responsibility for lost, late, misdirected, or non-delivered mail or other failure to deliver tickets prior to any deadline. PALM BEACH SANATAN VAIDIC SOCIETY reserves the right to limit the number of tickets distributed to each person. The USD $20 suggested donation per ticket for PALM BEACH SANATAN VAIDIC SOCIETY, could be made:

1) online at http://www.pbsanatansociety.org;

2) sending a written request indicating the number of tickets desired with the corresponding donation amount for said tickets to PALM BEACH SANATAN VAIDIC SOCIETY, 7802 130th Avenue North, West Palm Beach, FL 33412.

3) at specified locations; and

4) in person at events or directly through individual ticket sellers. To enter without a donation, send a letter stating that you wish to obtain a “NO DONATION” entry ticket.  Provide your name, address and phone number and a stamped, self-addressed envelope to: PALM BEACH SANATAN VAIDIC SOCIETY, 7802 130th Avenue North, West Palm Beach, FL 33412.  Only one “NO DONATION” ticket is allowed per household. When the minimum raffle ticket donation has been received and funds have cleared, the PALM BEACH SANATAN VAIDIC SOCIETY will complete the raffle ticket for the purchaser by filling in the name, address and phone number of the contributor.

Any returned and cancelled checks will automatically disqualify the ticket holder from winning any of the prizes.  Prior to the drawing, the PALM BEACH SANATAN VAIDIC SOCIETY intends to publish a list on its website which containing the names as it appears on all the tickets.  It is the responsibility of ticket holders to verify their ticket from the published list of names and to notify the PALM BEACH SANATAN VAIDIC SOCIETY at least two days prior to the drawing of any discrepancy.

Selection of Winner:

The raffle drawing for the PALM BEACH SANATAN VAIDIC SOCIETY’s fundraising Car Raffle will held on the evening of Saturday, December 16, 2017, in WEST PALM BEACH, FL except this date and all other dates stated in these rules may be extended at the absolute discretion of the PALM BEACH SANATAN VAIDIC SOCIETY. The winners do not need to be present in order to win. In order for the Grand Prize winner to receive the Grand Prize (the car) (subject to the other provisions in these rules), the winner will be responsible for picking up the car and paying all taxes and fees associated with the grand prize.

General Terms and Conditions:

By participating in this raffle, all ticket holders and everyone named on a raffle ticket accept and agree (1) to be bound by all the rules, limitations and restrictions set forth here and (2) that their names and/or likeness may be disclosed to and used by the news media and may otherwise be used by the PALM BEACH SANATAN VAIDIC SOCIETY for publicity purposes and the prize winners to be published in area newspapers or other media including television, radio, web and print. The winners will be published on the PALM BEACH SANATAN VAIDIC SOCIETY’s Website and/or Facebook Page. By participating in this raffle, each participant releases the PALM BEACH SANATAN VAIDIC SOCIETY and each of their respective directors, officers, employees and agents from any and all liability for injuries, losses or damages of any kind caused by any prize or resulting from acceptance, possession, use or misuse of any prize, and each winner agrees to indemnify and hold PALM BEACH SANATAN VAIDIC SOCIETY and each of their respective directors, officers, employees and agents harmless from any and all losses, damages, costs, expenses, rights, claims and actions of any kind arising in connection with or as a result of the winner’s acceptance or use of any prize.

Refunds:

All raffle ticket donations and contributions are final. No refunds will be made. No other refunds are available. PALM BEACH SANATAN VAIDIC SOCIETY assumes no responsibility for lost, late, misdirected or non-delivered mail or fax messages, emails or any other failure to receive orders or deliver receipts prior to the drawing deadlines. A raffle participant’s sole and exclusive remedy for the PALM BEACH SANATAN VAIDIC SOCIETY’s breach shall be limited to the return of the donation given for his or her raffle ticket(s). In no event shall the PALM BEACH SANATAN VAIDIC SOCIETY or their respective directors, officers, employees, members, committee members, agents, contractors, advisors, or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity.

DISCLAIMER OF ALL OTHER REPRESENTATIONS AND WARRANTIES:

THE GRAND PRIZE WILL BE TRANSFERRED TO THE GRAND PRIZE WINNER IN “AS IS, WHERE IS” CONDITION BY PALM BEACH SANATAN VAIDIC SOCIETY. THE PALM BEACH SANATAN VAIDIC SOCIETY DOES NOT PROVIDE ANY GUARANTEE OR WARRANTY, EXPRESSED OR IMPLIED, IN CONNECTION WITH THE VEHICLE OR ANY OTHER PRIZES. THE PALM BEACH VAIDIC SOCIETY ACCEPTS NO LIABILITY OR RESPONSIBILITY REGARDING THE MANUFACTURING OR CONDITION OF THE VEHICLE OR ANY OTHER PRIZES. NO WARRANTIES, EXPRESS OR IMPLIED, ARE MADE OR OFFERED BY THE PALM BEACH SANATAN VAIDIC SOCIETY.  THERE ARE NO REPRESENTATIONS OR WARRANTIES OTHER THAN AS SET FORTH IN THESE OFFICIAL RULES AND REGULATIONS. PALM BEACH SANATAN VAIDIC SOCIETY DISCLAIMS ALL OTHER REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE RAFFLE, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. A RAFFLE PARTICIPANT’S SOLE AND EXCLUSIVE REMEDY FOR PALM BEACH SANATAN VAIDIC SOCIETY’S BREACH SHALL BE LIMITED TO THE RETURN OF THE DONATION GIVEN FOR HIS OR HER RAFFLE TICKET(S). IN NO EVENT SHALL PALM BEACH SANATAN VAIDIC SOCIETY BE LIABLE TO ANY PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE.  ANY CLAIM OR DISPUTE AGAINST PALM BEACH SANATAN VAIDIC SOCIETY WITH RESPECT TO THE RAFFLE MUST BE BROUGHT WITHIN ONE YEAR AFTER THE CAUSE OF ACTION ARISES.
